Ethical Roots of the Modern Criminal Law

Venerdì 6 maggio, dalle ore 9 alle 11, in aula 3 (sede centrale), si tiene il seminario del Prof. Jean-Christophe Merle (Università di Vechta, Germania) dedicato al tema “Ethical Roots of the Modern Criminal Law”.

Il seminario del prof. Merle, professore di Filosofia e Teoria politica, parte di un progetto di scambio “Erasmus” in corso tra la Scuola Superiore Sant’Anna e l’Ateneo tedesco, si inserisce nell’ambito delle attività promosse dal “Gruppo di ricerca in Etica pubblica”, coordinate da Alberto Pirni presso l’Istituto Dirpolis della Scuola Superiore Sant’Anna.

Di seguito un sintetico abstract del tema che affronta il Prof. Merle che, per il suo carattere compiutamente interdisciplinare, si rivolge idealmente a tutte le componenti della Classe di Scienze Sociali e della Scuola Superiore Sant’Anna.

In the current debate on the justification of punishment, the most influential position is a mix-theory (general deterrence as the rationale for the institution of punishment, retributivism for the amount of punishment and the justification regarding human dignity.) I will defend another position, starting from the following premisses. (1) the logical consequences of the crime, (2) the justification of the modern rule of law, (3) the Kantian respect for human beings. From this premisses, I will argue for a full special prevention model, against both Kantian retributivism and mix theories, and I will explain its relationship to general prevention.
